Terms & Disclosures
LAW APPLICABLE: This rental-purchase agreement is regulated by State of Ohio law and may be enforced by the State Attorney General or private legal action.

OWNERSHIP: We are to retain full title to the above described instrument until payment in full has been made. When you have made all rental payments equal to the purchase price we will assign the title of the instrument to you. Upon return of the instrument, no refunds of monies will be owed to you for rental, maintenance or late fees charged.

PROMISE TO PAY: You promise to pay the payments according to terms shown on the front of this contract. It is your responsibility to notify us of any concerns or problems with the instrument or your account so that they can be resolved. We must be notified, at once, of any change of address, email, phone number, and/or the school your child is attending.

RENTAL TERM: This rental shall be from month to month (after initial 2 month trial period) and shall be automatically renewable each month. You will receive use of the instrument for successive one month terms provided monthly payments are made on or before due date and you fully comply with all conditions notated herein. The rental portion of each monthly charge will accumulate 100% toward the purchase of band/orchestral instruments for a maximum of 36 months.

MAINTENANCE AND REPAIR POLICY: We will maintain the instrument in good working order during the entire rental term provided payments are current and up-to-date. All repairs must be performed by technicians of McCutcheon Music LLC. We will not be responsible for costs or results of any repairs done by others. This coverage does not include deterioration of the instrument appearance from scratches, dents, or surface wear which do not affect the performance of the instrument. You are responsible for all repairs (with the exception of normal wear and tear) that occur to the rented instrument as a result of negligence or misuse. Should the instrument be returned with damages that have been sustained due to misuse and/or neglect, we reserve the right to charge you for such damages. You will be charged for missing and/ or damaged parts and accessories (drumsticks, mouthpieces, cleaning rods, etc.). Loaner instruments will be provided, when available, at no cost to you.

PROTECTION AGAINST THEFT: If the instrument is stolen before all rental payments under this agreement are due, we will replace it with an instrument of equal age, value and quality as determined by us (provided rental payments are current). Stolen instruments must be reported to the police immediately and a police report stating signs of forcible entry is required to claim damages of theft. The replacement instrument will be considered a new rental with no previous rental payments transferring.

LATE CHARGE: If a payment is more than 7 days late, you shall be charged a late fee of $5.00. No renter shall be entitled to more than three such monthly grace periods per calendar year. Returned checks will be assessed a $25 charge. DEFAULT: You are in default if you fail to make any payment when it comes due. Should you default on any monthly payment, we may assume that you do not wish to continue the contract and may reclaim the instrument wherever found, with or without your knowledge or permission. McCutcheon Music LLC is to retain full title to the above described instrument until full payment has been made. The renter agrees not to sell, pawn, remove from the state or otherwise dispose of instrument until payment in full is made and title is transferred.

TERMINATION BY McCUTCHEON MUSIC LLC: We may, without notice, terminate this agreement due to the failure of the renter to make required payments. Upon termination you shall immediately return the instrument to McCutcheon Music LLC (38 Marco Lane, Centerville, OH 45458) and pay any unpaid rental fees and other charges due, as well as any damage charges. If your account is delinquent and you fail to return the instrument, we reserve the right to charge a pickup service fee and attorney’s fees to send an agent or outside collection firm to collect our instrument. Past due fees are subject to collection.

TERMINATION BY RENTER: You may terminate this agreement by returning the instrument to McCutcheon Music LLC (38 Marco Lane, Centerville, OH 45458) in the same condition as given to you at the start of contract. Rental fees will accumulate until property is returned to McCutcheon Music. Rental fees paid cover the period of time you had custody of the instrument, whether rented instrument is actually used or not, and are non-refundable.

 EXCHANGES: You may exchange the instrument listed on this agreement for another instrument of equal or greater value, with all applicable payments transferring provided your account is current. The monthly payment amount may increase from previous contract if instrument exchanged is of higher value than the previously rented instrument. Payments cannot be combined or transferred between individuals or family members.

Please allow 1-2 business days for your rental to be processed prior to picking up your instrument.
